Australia has introduced a new visa option for those who are unable to depart Australia

The new legislative instrument issued on 3rd April recognizes COVID-19 pandemic as an ‘event’ qualified for inviting subclass 408 visa applications.

Due to the COVID-19 outbreak Australian Government has declared some important changes to the Temporary Activity Visa (Subclass 408)

Temporary Activity Visa, as the name suggests, is a temporary visa that allows the visa-holder to visit Australia for a short term in order to engage in specific activities such as youth exchange, community programs, cultural enrichment, religious work, research work, sports etc.

The visa also allows someone to participate in Australian Government Endorsed Events.
The new legislative instrument issued on 3rd April recognizes COVID-19 pandemic as an ‘event’ qualified for inviting subclass 408 visa applications.

This legislative change provides a pathway for eligible applicants to remain lawfully in Australia during the crisis.

To be eligible for this visa, one needs to satisfy Subclass 408 visa requirements and:

  • Be in Australia; and
  • Be unable to depart Australia as a result of the COVID-19 pandemic; and
  • Be directly associated to workforce shortages during the COVID19 pandemic in relation to areas including but not limited to, agriculture, aged care and public health.
  • Be the holder of a temporary visa that has 28 days remaining; or had been the holder of a temporary visa that expired at most 28 days ago.
  • Demonstrate that one is unable to meet the requirements of the visa one currently holds.
